Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Bookably platform, website, and services (collectively, the "Service") operated by Bookably App Inc. ("Bookably," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and agree to comply with these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Service

Bookably provides AI-powered dynamic pricing and demand forecasting tools for service-based businesses. The Service analyzes booking patterns and generates pricing recommendations and automated incentive offers to help fill underutilized appointment slots. The Service integrates with third-party scheduling and booking platforms.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@feltsense.com if you suspect unauthorized use.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to any part of the Service or its related systems
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Use the Service to transmit harmful code, spam, or malicious content
  • Resell, sublicense, or redistribute the Service without our prior written consent
  • Scrape, harvest, or collect data from the Service through automated means without authorization

5. Intellectual Property

The Service, including all software, algorithms, designs, text, graphics, and other content, is owned by Bookably App Inc. and protected by copyright, trademark, and other intellectual property laws. You retain ownership of all data you submit to the Service. By using the Service, you grant us a limited license to process your data solely to provide and improve the Service.

6. Pricing and Payment

Certain features of the Service may require a paid subscription. Pricing is displayed on our website or communicated during onboarding. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

7. Third-Party Integrations

The Service may integrate with third-party platforms (e.g., MindBody, Mariana Tek, Square). These integrations are provided for convenience and are subject to the third party's own terms and privacy policies. Bookably is not responsible for the availability, accuracy, or practices of third-party services.

8. AI-Generated Recommendations

The Service uses artificial intelligence to generate pricing recommendations and demand predictions. These outputs are advisory in nature and do not constitute financial, legal, or business advice. You are solely responsible for reviewing and approving any pricing changes or offers before they are applied to your business. Bookably does not guarantee specific revenue outcomes.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy and Data Processing Agreement, which describe how we collect, use, and protect your information.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

11. Limitation of Liability

To the maximum extent permitted by law, Bookably App Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising from your use of or inability to use the Service. Our total aggregate liability shall not exceed the fees you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Bookably App Inc. from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

Either party may terminate this agreement at any time. You may close your account by contacting us. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days following termination, after which it may be deleted.

14. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Service at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Delaware. Each party bears its own costs unless otherwise determined by the arbitrator.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, Data Processing Agreement, and Cookie Policy, constitute the entire agreement between you and Bookably App Inc. regarding the Service.
